Certifym.net — Terms of Service
Effective date: July 8, 2026
These Terms of Service (“Terms”) are a binding agreement between you and Certifym Exam Services, LLC, doing business as Certifym.net (“Certifym,” “we,” “us”) governing your use of the website located at certifym.net, our practice-exam services, and any related content or features (collectively, the “Service”). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Certifym provides subscription-based access to practice (“mock”) certification exams, including questions, answer options, answer keys, explanations, score reports, and related study content (collectively, the “Exam Content”). The Service is an independent study aid. Certifym is not affiliated with, endorsed by, or sponsored by any certification body, including but not limited to CompTIA, ISC2, ISACA, Amazon Web Services, Microsoft, Cisco, or PMI. All certification names, exam names, and related marks are trademarks of their respective owners and are used solely to identify the certifications for which our practice materials are designed.
All Exam Content is original material created by or for Certifym. It does not contain, and is not represented to contain, actual questions from any live certification exam. You remain solely responsible for complying with the candidate agreements, non-disclosure agreements, and exam policies of any certification body whose exam you sit.
2. Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You agree to provide accurate registration information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Accounts are personal and individual. You may not share your account or credentials with any other person, and you may not permit any other person to access the Service through your account. We may employ technical measures to enforce this, including limiting concurrent sessions and terminating duplicate logins. Organizations wishing to provide access to multiple individuals must purchase a subscription for each individual or contact us about group licensing.
3. Subscriptions, Billing, and Cancellation
3.1 Subscription. Access to Exam Content requires a paid subscription. Subscriptions are billed in advance on a recurring monthly basis at the price displayed at checkout, plus applicable taxes, and renew automatically until cancelled.
3.2 Payment. Payments are processed by our third-party payment processor (Stripe). By subscribing, you authorize recurring charges to your payment method. If a renewal payment fails, we may suspend or terminate your access.
3.3 Cancellation. You may cancel at any time from your account page. Cancellation stops future renewals; your access continues until the end of the current billing period.
3.4 Refunds. First-time subscribers may request a full refund within seven (7) days of their initial purchase by contacting support@certifym.net. Otherwise, all payments are non-refundable, and no refunds or credits are provided for partial billing periods, unused access, or dissatisfaction with results. Nothing in this section limits any non-waivable statutory refund rights in your jurisdiction.
3.5 Price changes. We may change subscription pricing with at least 30 days’ notice; changes take effect at your next renewal. Your continued use after the effective date constitutes acceptance of the new price.
4. License to Use the Exam Content
Subject to these Terms and payment of applicable fees, Certifym grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Exam Content through the Service, for your own individual, non-commercial exam preparation only.
This is a license, not a sale. You acquire no ownership interest in the Exam Content. All rights not expressly granted are reserved by Certifym.
5. Prohibited Conduct — Protection of Exam Content
The value of the Service depends on the confidentiality and integrity of the Exam Content. You agree that you will NOT, directly or indirectly:
(a) copy, reproduce, download, print, photograph, screenshot, screen-record, transcribe, or otherwise capture any Exam Content, except transient copies inherent to normal browser operation;
(b) publish, post, share, sell, license, distribute, or otherwise make any Exam Content available to any third party, in whole or in part, in any medium — including forums, file-sharing sites, social media, messaging groups, study groups, or “exam dump” collections;
(c) use any scraper, bot, crawler, script, automated tool, or programmatic method to access the Service or to harvest, extract, or download Exam Content; or access the Service’s application programming interfaces other than through the pages and features we provide;
(d) circumvent, disable, probe, or interfere with any security, authentication, rate-limiting, session-control, or content-protection measure of the Service;
(e) share, lend, rent, or transfer your account, or use another person’s account;
(f) use the Exam Content to create, train, or improve any competing product or service, including question banks, courses, or machine-learning models;
(g) reverse engineer, decompile, or disassemble any portion of the Service except to the extent such restriction is prohibited by applicable law;
(h) remove, alter, or obscure any copyright, trademark, or proprietary notice; or
(i) misrepresent the Exam Content as actual certification exam questions, or use the Service in violation of any certification body’s policies or any applicable law.
We monitor for indicators of prohibited conduct (including unusual access volume, concurrent usage, and content appearing on third-party sites) and may investigate suspected violations.
6. Intellectual Property
The Service and all Exam Content — including all questions, answer options, explanations, compilations, arrangements, software, designs, text, graphics, and trademarks — are owned by Certifym or its licensors and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws. The Exam Content also constitutes Certifym’s confidential information and valuable trade secrets; you agree to keep it confidential and not disclose it to any third party.
“Certifym” and the Certifym logo are trademarks of Certifym Exam Services, LLC. You may not use them without our prior written permission.
7. Enforcement; Remedies
If you violate Section 5 or 6, we may, without limiting any other remedy: (a) immediately suspend or terminate your account without refund; (b) revoke your license to the Exam Content; and (c) pursue all available legal and equitable remedies. You acknowledge that unauthorized copying or distribution of Exam Content would cause Certifym irreparable harm for which monetary damages would be inadequate, and you agree that Certifym is entitled to seek injunctive relief in addition to all other remedies, without the requirement of posting a bond. You agree to be responsible for Certifym’s reasonable attorneys’ fees and costs incurred enforcing these Terms against your willful violation, to the extent permitted by law.
8. User Conduct Generally
You agree not to use the Service in any manner that: violates any applicable law; infringes the rights of others; transmits malware or harmful code; imposes an unreasonable load on our infrastructure; or interferes with any other user’s use of the Service.
9. Copyright Complaints (DMCA)
If you believe content on the Service infringes your copyright, send a notice compliant with 17 U.S.C. § 512(c)(3) to our designated agent: DMCA Agent, Certifym Exam Services, LLC, P.O. Box 253 Tunbridge, VT 05077, email: legal@certifym.net. We will respond to valid notices, and we may terminate the accounts of repeat infringers.
10. Third-Party Services
The Service may link to or integrate third-party services (such as payment processing). Those services are governed by their own terms, and we are not responsible for them.
11. Disclaimers
THE SERVICE AND EXAM CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING: (a) CERTIFYM DOES NOT WARRANT OR GUARANTEE THAT YOU WILL PASS ANY CERTIFICATION EXAM, achieve any particular score, or obtain any certification, employment, or other outcome; (b) we do not warrant that the Exam Content mirrors the difficulty, wording, or coverage of any live exam; and (c) we do not warrant that the Service will be uninterrupted, error-free, or secure. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CERTIFYM AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, EXAM FEES, OR COSTS OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CERTIFYM’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO CERTIFYM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Certifym from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your violation of any law or third-party right, or your misuse of the Exam Content.
14. Termination
We may suspend or terminate your account and access to the Service at any time for violation of these Terms (without refund, per Section 7) or, for convenience, with a pro-rata refund of any prepaid unused period. Sections 4 (last sentence), 5, 6, 7, 11, 12, 13, 15, and 16 survive termination. Upon termination you must cease all use of the Exam Content; your confidentiality obligations regarding Exam Content continue indefinitely.
15. Dispute Resolution; Arbitration; Class Waiver
Please read this section carefully — it affects your legal rights.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that (a) either party may bring an individual claim in small-claims court, and (b) Certifym may seek injunctive relief in court for violations of Sections 5 or 6. The arbitration will be conducted in Windsor County, Vermont or, at your election, by videoconference or telephone.
YOU AND CERTIFYM EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Disputes must be brought on an individual basis only.
You may opt out of this arbitration agreement by emailing legal@certifym.net within 30 days of first accepting these Terms, stating your name, account email, and intent to opt out.
16. Governing Law
These Terms are governed by the laws of the State of Vermont, without regard to conflict-of-laws principles. Where Section 15 does not apply, the state and federal courts located in Windsor County, Vermont will have exclusive jurisdiction, and you consent to personal jurisdiction there.
17. Changes to the Service or Terms
We may modify the Service (including adding, changing, or retiring exams) at any time. We may update these Terms from time to time; material changes will be notified by email or prominent notice on the Service at least 14 days before taking effect. Your continued use after the effective date constitutes acceptance. If you do not agree to updated Terms, cancel your subscription before they take effect.
18. General
These Terms, together with our Privacy Policy (https://certifym.net/privacy/), are the entire agreement between you and Certifym regarding the Service. If any provision is held unenforceable, the remainder remains in effect, and the provision will be enforced to the maximum extent permissible. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be sent to your account email.
